General Terms and Conditions

One-to-One Coaching for Private Clients
Chris Luth

Version 1.0 | 1 October 2026

1. Scope and applicability

These General Terms and Conditions apply to one-to-one coaching services provided by Chris Luth to clients who engage me in their personal capacity, outside the exercise of a business or profession.

The scope, structure, number of sessions and fees of each coaching programme are set out in an individual Coaching Proposal or other written agreement.

These terms apply when they have been provided to and accepted by the client. Where specific arrangements in the Coaching Proposal or Coaching Agreement differ from these terms, those arrangements take precedence, subject to applicable law.

2. Coaching services

Coaching is a collaborative process supporting reflection, personal and professional development, informed decision-making and action.

The content, pace and direction of our conversations are adapted to the client's needs and circumstances. No particular personal, professional or financial outcome is guaranteed.

The professional standards, confidentiality arrangements and boundaries of our collaboration are described in the Coaching Agreement.

3. Fees and payment

Fees, applicable taxes and any instalment arrangements are specified in the Coaching Proposal or otherwise agreed in writing.

Unless otherwise agreed, invoices are payable within 14 days of issue.

If payment in instalments has been agreed, the amounts and payment dates will be communicated in advance.

If a payment is overdue, I will first send a reminder and provide the legally required opportunity to pay before claiming any statutory collection costs or taking further steps.

4. Scheduling and cancellation

Coaching sessions are scheduled by mutual agreement.

If either of us needs to reschedule or cancel a session, we will inform the other as early as possible, preferably at least 24 hours in advance.

No automatic cancellation fee applies to individual coaching sessions.

If sessions are repeatedly cancelled or missed, we will discuss how best to continue our collaboration.

5. Early termination and unused sessions

The client may end the coaching programme at any time.

I may end the programme where there are sufficiently serious reasons to do so, in accordance with applicable law.

If the programme ends before all agreed sessions have taken place, the fee for completed sessions will be calculated using the average session price of the agreed programme.

Any prepaid amount exceeding the fees due for completed sessions will be refunded within 14 days after the final settlement has been determined.

If the fees for completed sessions exceed the amount already paid, the remaining amount will be invoiced.

No additional fee is charged solely because the client decides to discontinue coaching. Completed sessions will not be retrospectively charged at a higher rate because the programme ends early.

These arrangements do not limit the client's mandatory statutory rights, including any applicable right of withdrawal.

6. Statutory right of withdrawal

Where a statutory right of withdrawal applies, the client may withdraw from the contract within the applicable period without giving a reason.

For qualifying distance or off-premises consumer contracts, this period is generally 14 days from the date the agreement is entered into, subject to any applicable extensions or exceptions.

The client may exercise this right by sending an unambiguous statement to chris@chrisluth.eu.

Further information, including instructions and a model withdrawal form, is available at chrisluth.eu/private-coaching/withdrawal.

If coaching begins during an applicable withdrawal period, the financial consequences of withdrawal will be determined in accordance with the relevant statutory requirements.

Nothing in these terms limits any statutory withdrawal right.

7. Professional responsibility and liability

I undertake to provide coaching with due professional care and in accordance with the professional standards described in the Coaching Agreement.

The client remains responsible for their own choices, decisions and actions.

I am responsible for any failure to fulfil my contractual or legal obligations to the extent provided by applicable law.

Nothing in these terms excludes or restricts liability where doing so would be unlawful.

8. Privacy and personal information

I handle personal information confidentially and in accordance with applicable data-protection legislation, including the General Data Protection Regulation (GDPR).

Information about how I collect, use, protect and retain personal information, and about the client's rights, is available in my Privacy Notice at chrisluth.eu/privacy.

9. Concerns and complaints

If the client has concerns about the coaching or our collaboration, I encourage them to raise these with me so that we can explore an appropriate resolution.

Formal complaints may be submitted to chris@chrisluth.eu. I will acknowledge them and respond within a reasonable period.

This does not restrict the client's right to pursue other remedies available under applicable law.

10. Applicable law and disputes

Dutch law governs our agreement. This does not limit any mandatory consumer protections that apply under the relevant rules of private international law.

If a dispute arises, we will first seek to resolve it through discussion, where appropriate.

If no resolution can be reached, either party may bring the matter before a court with jurisdiction under the applicable rules.
